After a long and drawn out legal battle, the proposed apartment complex development on Rowland Street, Warwick, has been approved.
The Planning and Environment Court has cleared the path for the development to go ahead.
The development will consist of 34 single-storey units as opposed to the previous plan that included a mix of two-storey units.
Developer CH Property Holdings had been locked in a planning battle with Southern Downs Regional Council for years but a revised plan satisfied previous concerns.
The plan includes the more open space, fewer units and a reduction in height.
Southern Downs Regional Council’s Director of Planning and Environment Ken Harris said the number of stages the development would be completed in had also been reduced.
“The original development application was for 39 units to be constructed over 14 stages,” he said.
“The settlement, in accordance with the judgment from the Planning and Environment Court, is for 34 units to be constructed over 10 stages.
“This means there will now be five units and four stages less than sought in the original application.”
Mr Harris said the council did not have any knowledge of the scheduled start of the development but that the initial stage would need to be completed with four years.
“The entire development must be completed within a period of 10 years, with stage one needing to be completed within the first four years from the date of the judgement,” he said.
“The commencement date of the development is entirely a matter for the developer to determine.
“If the development proceeds and the units are constructed, it is hoped that local tradespeople and building material suppliers will be able to participate in the construction.
“If fully constructed, the units would provide for a modern multiple unit complex, accommodating up to 34 families.”
